Terms and Conditions relating to the ballot to be part of the virtual audience including VIP access to the virtual #ILoveUnited fan event taking place on 12 December 2020.

These terms and conditions are broken down into two parts. Part A deals with terms applicable to the ticket ballot and Part B sets out the terms applicable to the spot prize draws. Both parts are applicable to anyone entering the ticket ballot. 

PART A

Relevant background details:
1. Manchester United Football Club Limited ("MU" or “we”) whose registered office is at Old Trafford, Sir Matt Busby Way, Manchester M16 0RA, is the promoter of this campaign, giving fans the chance to become part of a virtual audience including VIP access to the virtual #ILOVEUNITED fan event taking place on Saturday 12 December 2020 in connection with the Manchester United v Manchester City premier league football game (the “Event”).

2. The Event will be available to fans to stream live however; we would like to give up to 100 fans the chance to become part of the virtual audience which includes VIP access to the Event. 

3. The Event and this Ballot will be sponsored by DHL. Employees of MU or DHL any of their associated companies or subsidiaries (and their families) are excluded from entering the Ballot (defined below).

4. By applying for a ticket to become part of the virtual audience which includes VIP access to the Event you agree and accept to be bound by these terms and conditions and confirm that all information submitted is true, accurate and complete. MU reserves the right to verify the eligibility of any and all entrants and may, in its sole discretion, disqualify any entrant that fails to satisfy the eligibility requirements. Entrants shall at all times act in good faith towards MU and the Ballot.

How to apply:

5. To enter the ticket ballot for a chance to become part of the virtual audience which includes VIP access to the Event (the “Ballot”) you must:

(i) be resident in India;
(ii) be aged 18 years or over at the time of entry; and
(iii) register your interest by completing the relevant data entry fields via any one of the following methods, before 23:59 GMT on Sunday 6 December 2020 (the “Closing Date”),:

a) the official Manchester United website at www.manutd.com/iloveunited; 
b) MU’s social media accounts (including its official Facebook, Instagram, Youtube and Twitter pages); or
c) any other method of entry which MU makes available.*

(the “Main Entry”)

* If you enter this Ballot via a link sent to you in a Manchester United email, please note that this link is exclusive to you. Any further entries made using this link will be invalid and will be excluded from the Ballot. The email address you input when entering the Ballot via the link must match the email address to which the Manchester United email was sent. 

6. In addition to the Main Entry, entrants are also eligible to gain one further automatic entry into the Ballot by: (i) downloading the Manchester United Official App (the “App”); and (ii) registering themselves within the App. A link to download the App will be made available to entrants following the making of the Main Entry. For the avoidance of doubt, any person who makes a Main Entry and who is already registered within the App prior to the commencement of this Ballot will automatically obtain one additional entry into the Ballot. Please read paragraph 7 below before downloading the App. 

7. Downloading, using and accessing the App is subject to terms and conditions which are available on application stores or third party platforms on which the App is made  available to download (the “App Terms and Conditions”). Entrants into this Ballot are required to read and agree to the App Terms and Conditions prior to downloading, using or accessing the App. 

8. Entry into the Ballot is free (except for any applicable data usage charges) and on the basis of one entry per person (except in accordance with paragraph 6 whereby an entrant can gain two entries into the Ballot).  

9. Any entries received after the Closing Date will not be entered into the Ballot. The Ballot will take place as soon as reasonably practicable following the Closing Date

10. Any individual entering the Ballot to obtain a ticket for a third party shall be deemed to be acting with the consent of the third party for whom they are making that entry, including acting with the authority of the third party to agree to these terms and conditions on their behalf. 
Tickets to the Event:

11. After the Closing Date MU will conduct a draw and select names at random from the Ballot and allocate a ticket to those entrants who are randomly selected which will, enable them to become part of the virtual audience to the Event including VIP access to the Event (details of what the VIP access includes are detailed below). We will allocate tickets up to 100 randomly selected entrants. 

12. The entrants who are selected will receive an email as soon as reasonably practicable following the draw along with further instructions on how to access the Event.

13. All tickets are personal to the entrant, non-transferable and no cash alternative is available.

14. Anyone who enters this Ballot acknowledges and agrees that spaces in the virtual audience which includes VIP access are limited and are not guaranteed by receiving a ticket. Places in the audience will be allocated to ticket holders on a first come first serve basis until all places are occupied. Anyone whose access to the virtual audience is terminated or dis-connected due to technical or other reasons may not be able to re-join after they have been dis-connected.  
Conditions of participating in the virtual audience:

15. The virtual audience including VIP access will take place through a video sharing platform of MU’s choice and it will start at a time and date and be for a duration specified by MU and communicated to successful ticket holders. 

16. The virtual audience will be a live feature during the Event. 

17. MU reserves the right to disable the connection between any ticket holder and the platform used to feature the virtual audience and provide VIP access to the Event if, in MU’s absolute discretion, it considers that: (i) someone is acting offensively or inappropriately; (ii) someone has gained unauthorised access; and/or (iii) if someone is considered to be using the platform to promote the interests of a third party or their own goods or services. 

18. Anyone who receives a ticket and chooses to participate as part of the virtual audience and the VIP access:

(i) must have access to the video sharing platform chosen by MU which may have applicable terms and conditions which the ticket holders may be required to accept; and 

(ii) shall not be permitted take any screenshots, photographs or video recordings during the Event.

19. MU shall have no responsibility to anyone who enters the Ballot if the Event (and therefore the virtual audience and VIP access) is postponed, cancelled or delayed for any reason.

20. Anyone who is allocated a ticket is expected to conduct themselves appropriately at all times during the Event.
VIP features:

21. Anyone who is allocated a ticket to take part in the virtual audience will also get exclusive VIP access to the Event which may include an opportunity to (virtually):

(i) meet and greet a Manchester United Club Legend;

(ii) ask a Manchester United Club Legend a question during the Event; and

(iii) be asked a question by a Manchester United Club Legend or by any other MU personnel.

22. MU does not guarantee who the Manchester United Club Legend(s) will be and will not enter into any correspondence with any ticket holder regarding the identity of the Club Legend(s).

23. Anyone selected to ask a question or to answer a question will be selected at random. There is no guarantee that a ticket holder will get the opportunity to answer or ask a question. 

24. MU may also run spot prize draws during the Event. Anyone who is allocated a ticket will be automatically entered into the spot prize draws. The spot prizes which a ticket holder may win are:

(i) a Cadburys hamper; or
(ii) a copy of PES with Konami; or
(iii) a Manchester United shirt courtesy of Chevrolet.

25. Terms and conditions apply to the prizes listed above and they are located below in the section headed Part B below. 

26. If you win a spot prize you acknowledge and agree that we may announce you as a winner and disclose your name and location during the Event and you hereby give MU your consent to make any such announcement during the Event. 
Footage of the Event and the virtual audience: 

27. By entering the Ballot you agree to, acknowledge and accept that: 

(i) we may record, take footage and screenshots of the virtual audience at any and all times as well as any elements of the VIP access (such as, but not limited to, Club Legends asking audience members questions) and that as a ticket holder, you may feature in the video recording, footage or images (the “Content”);

(ii) we own the Content and all intellectual property rights in it; 

(iii) we may use the Content however we choose for example, but without limitation, we may use the Content in conjunction with other third party content and/or use the Content as part of MU’s commercial campaigns; 

(iv) we do not guarantee that the Content will be used and/or featured during the Event or for any other purpose and, we cannot guarantee that you will feature in it; 

(v) if we do choose to use the Content (in whole or in part) then we may do so anywhere in the Wold, on any media including, but not limited to, on our web-pages (including but not limited to www.manutd.com), any of our social media channels, on our MUTV channel and at any physical location (for example, banners, posters and digi-boards); and

(vi) we may or may let other people use, reproduce, modify or edit the Content or make things inspired by it for us.
General:

28. To the extent legally permissible, MU shall have no liability whatsoever to any entrants who enter the Ballot and/or any ticket holder for any reasons whatsoever including, but not limited to:

(i) if the Event is cancelled or re-arranged; 

(ii) if a ticket holder is refused access for failing to adhere to any applicable conditions; 

(iii) a ticket holder cannot access the platform due to this being at full capacity; and/or

(iv) due to any technical failure or malfunction and/or any other problem with any network, server, system or otherwise which the video sharing platform selected by MU to host the audience and VIP features.

29. MU cannot guarantee that the system and/or service used to host the Event and the virtual audience and VIP access will be free from errors, omissions or that it will be available or uninterrupted at all times.

30. MU reserves the right to cancel or amend the Ballot or these Part A terms and conditions without notice when reasonably necessary for the purpose of administering the Ballot. 

31. The Ballot, together with these Part A terms and conditions, is governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.

PART B
TERMS AND CONDITIONS APPLICABLE TO THE SPOT PRIZES WHICH MAY BE AWARDED DURING THE EVENT
1. Any defined terms used in this Part B shall have the meanings given to them in Part A unless otherwise defined below. 

2. Anyone who gains a ticket to the virtual audience is also given the opportunity to win a spot prize. The spot prizes are:

(i) a Cadburys hamper; or
(ii) a copy of Konami’s Pro Evolution Soccer with Konami; or
(iii) a Manchester United football shirt courtesy of Chevrolet
(each a “Prize” and together the “Prizes”). 
3. Five people will win a Cadbury’s hamper. The hamper will include various Cadbury items. MU gives no guarantee as to the size and contents of the hamper. 

4. Three people will win a copy of Konami’s Pro Evolution Soccer in a format of their choice.

5. Three people will win a season 20/21 Manchester United home football shirt courtesy of Chevrolet. The shirt will be in a size of the applicable winner’s choice. 

6. The Prizes are non-transferable and there are no cash alternatives. MU reserves the right to substitute any Prize with another of a similar nature at any time.

7. All ticket holders will be automatically entered into the spot prize draws. Once a ticket holder has won a Prize they will be removed from the next Prize Draw. 

8. Each of the winners of a Prize will be selected at random from all of the ticket holder entries (excluding anyone who has already won a Prize (if applicable)).

9. The order of the Prize draws will be at MU’s discretion. 

10. The winners will be notified during the Event as their names and locations will be announced by MU during the Event. The winner will then be contacted by MU following the Event to make arrangements re: their prize. Anyone who enters the ticket Ballot hereby grants MU consent to making any such announcement including announcing their names and location of the spot prize during the Event, if they are a winner. 

11. The winners will also be required to give their consent to: (i) their surname and country to be disclosed to any person requesting that MU confirms the identity of the winners; and/or (ii) for promotional purposes. The Winners may raise any concerns regarding this paragraph with MU.

12. If MU cannot successfully contact a winner within a reasonable length of time, or if a winner is unable or unwilling to accept their Prize, or if a winner does not meet the eligibility requirements, subsequent draws will take place until a new winner is found who is able, willing and eligible to accept the Prize. This new winner shall be deemed to be a winner. 

13. Subject to paragraph 11 above, details of each of the winner’s surname and county will be made available to the public upon request from Manchester United Football Club Limited, Sir Matt Busby Way, Old Trafford, Manchester M16 0RA two weeks after the Closing Date (subject to data protection legislation).

14. MU reserves the right to cancel or amend the spot prize draws or these Part B terms and conditions without notice when reasonably necessary for the purpose of administering the spot prize draws.

15. The spot prize draws together with these part B terms and conditions are governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.
